New Game Plan for Corporations Preventing Global Corruption

Patrick Oot and Scott Herber from Inside Counsel recently reported on the Obama Administration's release of The U.S. Global Anti-corruption fact sheet. This agenda covered numerous action plans to raise awareness for international transparency and restrict global corruption. In particular, Inside Counsel mentioned how corporations might react to the government’s plan of strengthening global Foreign Corrupt Practices Act enforcement:

“As a result, corporations might consider stepping up compliance and monitoring programs to protect international brands by promoting an image of transparent and accountable partners. In addition, U.S. businesses must prepare to meet the demands for investigating and monitoring electronically stored information (ESI) located in foreign jurisdictions. Global investigations require looking beyond traditional preserve-collect-review and produce strategies, so counsel must account for foreign legal traditions, cultures and languages.”

 The United States alone has “since 2009, resolved criminal cases against more than 50 corporations worldwide with penalties of $3 billion.”
